1. Introduction

Welcome to my-business.co.ke (“we,” “our,” “us”). These Terms & Conditions (“Terms”) govern your use of our website [www.my-business.co.ke] and the digital services we provide, including vCards, mini-websites, templates, and related features (the “Services”).

By creating an account, subscribing to a plan, or using our Services, you agree to these Terms. If you do not agree, please discontinue use.


2. Eligibility

You must be at least 18 years old, or of legal age under applicable law in Kenya, to create an account and use our Services.


3. Services Provided

We provide subscription-based access to digital vCards and mini-websites, including different feature packages (“Plans”). The available features and templates vary by plan. We reserve the right to update, modify, or discontinue features, templates, or pricing at our discretion, with reasonable notice to subscribers.


4. Accounts & Security

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree not to share your login with unauthorized persons.
  • Any activity under your account will be considered your responsibility.


5. Subscriptions & Payment

  • All Services are offered on a subscription basis (monthly or annual).
  • Payments must be made in advance, using M-Pesa, credit/debit card, or other accepted methods.
  • Prices are quoted in Kenyan Shillings (KES) unless otherwise stated.
  • Value Added Tax (VAT) at the prevailing Kenyan rate (currently 16%) will apply to all charges.
  • Failure to pay may result in suspension or termination of your account.


6. Trials & Promotions

We may offer free trial periods for certain Plans. At the end of the trial, you will be required to select a paid Plan to continue using the Service.

Trials are limited to one per customer and may be revoked if abused.


7. Refunds & Cancellations

  • Subscription fees are non-refundable, except where required by law.
  • You may cancel your subscription at any time via your account dashboard. Cancellation will prevent future renewals but does not refund fees already paid.
  • In case of technical issues caused by us that prevent use of the Service, we may, at our discretion, offer credits or partial refunds.


8. Acceptable Use

You agree not to use the Services for:

  • Illegal or fraudulent activities;
  • Content that is defamatory, obscene, hateful, or violates intellectual property rights;
  • Distribution of malware, spam, or unauthorized advertising.

We reserve the right to suspend or terminate accounts found in violation.


9. Intellectual Property

  • All templates, software, code, and design remain our property or the property of our licensors.
  • You are granted a limited, non-exclusive, non-transferable right to use the templates and Services while subscribed.
  • You may not copy, resell, or redistribute our platform without prior written consent.


10. Data Protection & Privacy

We process personal data in accordance with the Kenya Data Protection Act (2019).

By using our Services, you consent to the collection, use, and storage of your data as described in our Privacy Policy.


11. Limitation of Liability

  • Services are provided “as is” without warranties of any kind.
  • To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages.
  • Our total liability in any claim shall not exceed the amount paid by you in the past 3 months for the affected Service.


12. Termination

We may suspend or terminate your account if you:

  • Violate these Terms,
  • Fail to pay subscription fees,
  • Engage in misuse of the Services.


You may terminate your account at any time. Provisions relating to liability, intellectual property, and payments survive termination.


13. Governing Law & Dispute Resolution

These Terms are governed by the laws of Kenya. Any disputes will be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya. We encourage good-faith negotiations before escalating disputes.


14. Changes to Terms

We may update these Terms from time to time. Changes will be effective once posted on our website. Continued use of our Services after changes constitutes acceptance.
